9. DISPUTE RESOLUTION AND JURISDICTION

To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. 9.2 Choice of Forum: If and only if the dispute is not resolved through pre-suit mediation, any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts of a jurisdiction determined solely by The Church, provided that such jurisdiction is not prohibited from enforcing these Terms. The Church reserves the right to initiate or transfer any action to any other jurisdiction which it deems appropriate, in its sole discretion. Thou dost waive any and all objections to the exercise of jurisdiction over thee by such courts and to venue in such courts.

9.3 Governing Law: Notwithstanding the above, these Terms and any separate agreements whereby The Church provides thee Services shall be governed by and construed in accordance with the laws of The Church, without regard to its conflict of law provisions.

9.4 Waiver of Class Actions: Thou dost agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

By using this Site, thou dost expressly agree to the dispute resolution procedures set forth above.
